Terms of Service

These Terms of Service ("Terms") govern your use of the Vigil mobile application ("App," "Service") operated from South Carolina, United States. By using Vigil, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Vigil is a non-custodial Solana blockchain tool that provides:

Wallet watching — monitor activity on public Solana wallet addresses
Token feed — view trending and recently listed tokens
Token scanner — on-chain safety analysis of token contracts
Portfolio tracker — view your token holdings and profit/loss
Token swaps — execute token swaps via Jupiter aggregator

Vigil is a software tool that interfaces with the Solana blockchain and third-party services. We do not operate an exchange, brokerage, or financial advisory service.

2. Eligibility

You must be at least 18 years old to use Vigil.
You must comply with all applicable laws in your jurisdiction, including any laws relating to cryptocurrency.
You are solely responsible for determining whether your use of Vigil complies with local regulations.
By using the App, you represent that you are not located in a jurisdiction where cryptocurrency transactions are prohibited.

3. Non-Custodial Nature

Vigil never has custody of your assets. All blockchain transactions are constructed by the App and signed by your external wallet application (e.g., Seed Vault, Phantom, Solflare) using the Solana Mobile Wallet Adapter protocol. You maintain sole control of your private keys and funds at all times. We cannot freeze, reverse, or recover any transaction.

4. Platform Fee

Vigil charges a 1% platform fee (100 basis points) on token swaps executed through the App.

The fee is deducted from the swap output amount.
The fee is collected in the output token and sent to the Vigil fee wallet.
The fee transfer is included in the same atomic transaction as the swap — if the swap fails, no fee is collected.
The fee amount is displayed in the swap interface before you confirm each trade.
Network fees (Solana transaction fees) are separate and paid directly to the Solana network.

We reserve the right to modify the fee rate. Any changes will be reflected in the App before you confirm a swap.

5. No Financial Advice

Nothing in Vigil constitutes financial, investment, legal, or tax advice. Token safety scores, portfolio profit/loss calculations, market data, and trending feeds are provided for informational purposes only. They do not represent recommendations to buy, sell, or hold any token. You are solely responsible for your trading decisions.

6. Assumption of Risk

By using Vigil, you acknowledge and accept the following risks:

Market risk — Cryptocurrency prices are volatile. You may lose some or all of your investment.
Smart contract risk — Tokens and DeFi protocols may contain bugs or be exploited. Token scanner results are informational and do not guarantee safety.
Blockchain risk — Transactions on the Solana blockchain are irreversible. Failed or stuck transactions may result in loss of funds or network fees.
Slippage risk — Actual swap prices may differ from quoted prices due to market movement between quote and execution.
Third-party risk — Vigil relies on third-party services (Jupiter, Helius, DexScreener) that may experience downtime, errors, or provide inaccurate data.
Regulatory risk — Laws governing cryptocurrency may change. You are responsible for compliance with applicable regulations.

7. Prohibited Uses

You agree not to use Vigil to:

Violate any applicable law or regulation
Engage in money laundering, terrorist financing, or sanctions evasion
Abuse, exploit, or circumvent rate limits or security measures
Reverse engineer, decompile, or extract source code from the App
Use automated systems (bots, scrapers) to interact with the App in excess
Interfere with the App's operation or other users' access

8. Intellectual Property

The Vigil name, logo, and App design are owned by us. You may not use our branding without written permission. Blockchain data displayed in the App is public information. Third-party trademarks (Solana, Jupiter, etc.) belong to their respective owners.

9. Disclaimer of Warranties

VIGIL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA DISPLAYED IN THE APP, INCLUDING TOKEN PRICES, SAFETY SCORES, AND TRANSACTION HISTORY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIGIL, ITS OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL PLATFORM FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50 USD), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Vigil, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law.

12. Modifications

We reserve the right to modify, suspend, or discontinue Vigil (or any part of it) at any time without notice. We may update these Terms from time to time. Changes are effective when posted. Continued use after changes constitutes acceptance. Material changes will be communicated via an in-app notice.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in South Carolina. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Vigil regarding your use of the App.
